The “LAW ON PROTECTION OF PERSONAL DATA” numbered 6698 was published in the Official Gazette dated 07.04.2016 and numbered 29677. With this law, website owners have become “Data Controllers” and have also taken on certain obligations. We asked our company’s lawyer Av. Esin Tunceroğlu Göçgeldi for a summary of the topic:
Do you know the responsibilities that the “Law on Protection of Personal Data” accepted by the Grand National Assembly of Turkey brings to you, enacted to protect fundamental rights and freedoms of individuals, especially the privacy of private life, in the processing of personal data, and to regulate the obligations of real and legal persons processing personal data and the procedures and principles they must follow?
Under this law, you are now required to state the purpose for which you are requesting users’ personal information when collecting it. You cannot process personal information without the person’s explicit consent, and you have the obligation to delete, destroy, or anonymize personal data processed in accordance with the provisions of this and other laws, ex officio or upon the request of the relevant person. One of the most important points of the law is that you can no longer store personal data in data centers located abroad without the person’s consent.
Those who fail to fulfill the data security obligations of the law on protection of personal data enacted in this process will be subject to administrative fines ranging from 15,000 Turkish Liras to 1,000,000 Turkish Liras.
